Denied Social Security Disability
Social Security offers benefits to many disabled Americans, allowing them to live their lives to the fullest without the ability to earn a living wage. Sadly, though, it rejects many applications from these people as well, forcing them to endure a long series of hearings and appeals just for a chance to receive benefits.
To be eligible for either Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI), you have to be able to prove that you have a serious medical condition, that the condition prevents you from maintaining employment, and that the condition will last at least a year or is a terminal illness.
This is challenging for some people, as a medical diagnosis by itself doesn’t always indicate how disabled an individual patient is. For this reason, statements from an attending physician will often be used to bolster a disability case. Additionally, the application for Social Security disability benefits will ask the person about their other activities, which can also be affected by disability.
Despite the best efforts of disability applicants and their doctors, legitimate claims are sometimes turned down. People often have to fight for disability benefits at a time when they are most vulnerable.
When to get a disability attorney
If you’re facing a long-term disability and your application for benefits was rejected, you know how stressful the experience can be. You may be unable to manage your finances in the meantime, and you may have a family that relies on you for support. If this is the situation you’re facing right now, know that it isn’t the end. There’s hope at the end of the appeals process, and a disability attorney can help you get there much faster.
