Disability Back Pay

The process of applying for Social Security benefits can be long, and the time it takes to get an answer can be even longer. Add in the denials that are all too common for first-time applicants, and you might be looking at months, if not years, without any of the benefits you’re entitled to.

Because of how long the process takes even for successful claims, most people who receive benefits are eligible for a back payment in addition to their monthly benefits check.

Types of disability back pay

Your application for disability can be delayed for two reasons. The first is because of a five-month waiting period that affects applications for SSDI, or Social Security Disability Insurance. If your application is not processed within this period, you will be owed back payments for additional month after the initial five.

Other times, the person may put off applying for disability, for any number of reasons. Maybe they didn’t realize they were disabled, or they didn’t understand the extent of the disability. Whatever the case, the person is entitled to benefits for any month after they became unable to work, up to a maximum of twelve months.

SSI recipients will usually not qualify for retroactive benefits unless there is a delay in processing their application.

Receiving disability back pay

If you receive SSDI and qualify for disability back pay, you will generally receive the entire amount in one payment, usually within two months of being approved. SSI recipients who do qualify for a back payment will receive three divided payments, six months apart.

Disability back pay does not go farther back than twelve months. If you’ve been disabled for longer than that and you still haven’t received any benefits, you might be wondering how you’ll be compensated for the time you’ve spent waiting. A legal counselor can help ensure that you get the full amount that you’re entitled to.
