Florida is a “no-fault” state in regards to automobile accidents, meaning that regardless of who caused the accident, all injuries sustained are the responsibility of the injured party’s insurance carrier. There may be exceptions if the injuries are severe, disfiguring, or fatal. In general, however, a car accident is not the basis of a personal injury lawsuit in Florida.
